This is Body Cravings The Skinxperience. The following terms and conditions (the "Terms") apply to your use of bodycravingstheskinxperience.com (the "Site") and the services provided by 12:04, LLC DBA Body Cravings The Skinxperience ("we," "us," "our"). By accessing or using the Site and our services, you agree to be bound by these Terms. If you do not agree with these Terms, please do not use the Site or our services.

1. Use of the Site and Services
1.a You must be at least 18 years old to use the Site and our services. By using the Site, you represent and warrant that you have the legal capacity to enter into these Terms.
1.b To access certain features of the Site, you may be required to create an account. You agree to provide accurate and complete information when creating your account and to keep your account information up to date. You are responsible for maintaining the confidentiality of your account and password and for all activities that occur under your account.
1.c Prohibited Activities: You agree not to use the Site or our services for any unlawful purpose or in any way that could harm or disrupt the Site or our services. Prohibited activities include, but are not limited to:
- Engaging in any fraudulent or deceptive practices.
- Interfering with or disrupting the Site's functionality.
- Uploading or transmitting any viruses or malicious code.
- Infringing on the intellectual property rights of others.

1.d All terms and conditions additionally apply to guests in attendance to a group/party booking: "skinxperience party".

2. Custom products 

2.a Products cannot be returned or exchanged. Please carefully consider your choices and provide accurate specifications during the customization process.
2.b Customer Responsibility: When creating a custom product, it is essential to follow the instructions provided by our designated instructors. If a customer creates a product they are not satisfied with, it is considered their responsibility. Body Cravings The Skinxperience cannot be held liable for any dissatisfaction resulting from personal choices made during the creation process.

3. Appointments and Experiences
3.a Non-Refundable Experiences: All appointments and experiences at Body Cravings The Skinxperience are non-refundable. Please ensure that you are able to attend your scheduled appointment before booking or reschedule prior to 24 hours before appointment date. A portion of each sale is donated to helping children in need and thus non refundable. If you no call no show, you forfeit all payments made and the ability to reschedule. Avoid forfeit by cancelling within 24 hours of appointment please.
3.b Transferability of Appointments: Appointments are transferable. If you are unable to attend your scheduled appointment, you may transfer it to another person or to another date. Please contact us within 24 hours of the original appointment in advance to arrange the transfer.
3.c Participant Waiver: By participating in our experiences, you acknowledge and agree to sign a participant waiver form. This waiver releases Body Cravings The Skinxperience from any liability for injuries, accidents, or damages that may occur during the experience.

4. Intellectual Property
4.a All content on the Site, including text, graphics, logos, images, and software, is the property of Body Cravings The Skinxperience or its content suppliers and is protected by intellectual property laws. You may not reproduce, distribute, or create derivative works from any content on the Site without our prior written permission.

5. Limitation of Liability
5.a To the fullest extent permitted by law, Body Cravings The Skinxperience shall not be liable for any indirect, incidental, special, or consequential damages arising out of or in connection with your use of the site or our services. Our total liability to you for any claims arising from the site or our services shall not exceed the amount you paid to us for the services.

6. Indemnification

6.a You agree to indemnify and hold harmless Body Cravings The Skinxperience, its affiliates, and their respective officers, directors, employees, and agents from any claims, liabilities, damages, and expenses (including reasonable attorneys' fees) arising out of or in connection with your use of the Site or our services, your violation of these Terms, or your violation of any rights of another.

Your continued use of the Site and our services after any changes to the Terms constitutes your acceptance of the changes.

8.a These Terms shall be governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict of law principles. Any legal action or proceeding arising out of or related to these Terms or your use of the Site shall be brought exclusively in the federal or state courts located in Texas.
